For Hosting Packages

All services provided by Webolocity may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Webolocity and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.

The following content will not be tolerated on any package.

1. Audio or Video Files, except .swf format, which are done in such a way that would cause excessive CPU drainage and could ultimately crash the server. Many efficient delivery methods are now available which would not cause excessive loads. If in doubt, contact us first.

2. Any content that is considered to be offensive. This includes but is not limited to pornography and sex-related merchandising, gaming, wagering or other gambling sites, hate sites, hacker sites or any other type of site which shows or supports any illegal content. Webolocity does not host any adult content of any type on its servers. We also do not permit sites which are linked to any of the above adult content or linked to adult content directories.

3. CGI based Forums/BBS. There are a number of good PHP based Forums available, some of which come included with Fantastico De Luxe.

4. Software downloads, unless created by the client or permission is given to the client for free distribution under GPL guidelines.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Webolocity servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

- Pirated software
- Hacker programs or archives
- Warez sites

Webolocity will be the sole arbiter as to what constitutes a violation of this provision.

E-mail
Spamming, or the sending of unsolicited e-mail including, without limitation, commercial advertising, opt-in emails, and informational announcements, from a Webolocity server or using an e-mail address or domain that is maintained on a Webolocity machine as reference is strictly prohibited. Webolocity will be the sole arbiter as to what constitutes a violation of this provision. 

A user shall not use another site's mail server to relay mail without the express permission of the site. Webolocity will be the sole arbiter as to what constitutes a violation of these provisions.

MLM (Multi-Level Marketing)
MLM websites are strictly forbidden on any Webolocity servers. These sites generally are scams and use our SMTP services for SPAM. Webolocity will be the sole arbiter as to what constitutes a violation of this provision. 

System And Network Security
Any attempt to undermine or cause harm to a server, or customer, of Webolocity is strictly prohibited.

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Limitation Of Liability
Webolocity shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Webolocity servers going off-line or being unavailable for any reason whatsoever. Furthermore, Webolocity shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Webolocity servers. All damages shall be limited to the immediate termination of service.

Violations of these Acceptable Users Policies should be referred to us using Contact Us page! All complaints will be investigated promptly. Failure to follow any term or condition may be grounds for immediate account deactivation.

Disclaimer
Webolocity provides a 99.9% uptime guarantee with the exception of circumstances beyond our control. Please see our SLA (Service Level Agreement) for more details of guarantee and exclusions.

Webolocity cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Webolocity are resold. Thus, certain equipment, routing, software, and programming used by Webolocity are not directly owned or written by Webolocity. Webolocity holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Webolocity sees fit.

Account Activation
By activating your account with Webolocity, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer.

If you sign up for an account and do not follow our terms, no refunds will be given.

Account Cancellation
If at anytime you choose to cancel your hosting or email account, you may do so by submitting the cancellation form at: http://www.webolocity.com/cancellation.shtml. I understand that cancellation of my hosting and/or email account will discontinue any further charges for future hosting plan or email charges and that this does not intitle me to a refund of pre-paid plan charges. Webolocity reserves the right to not issue any refunds upon a customers account cancellation.

Ammending the Terms of Service
Webolocity retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
